1. SPONSOR: KRCW-TV/Portland’s CW32, 10255 SW Arctic Drive, Beaverton, Oregon 97005.
2. CONTEST DATES:
Contest runs from July 22, 2015 through October 12, 2015 (the “Contest Period”). Online entries will be accepted from July 22, 2015 beginning at 6:00am PST, through 11:59:00pm PST on September 8, 2015 (the “Online Entry Period”). Twenty finalists will be selected to participate in the On-Site Audition Event to be held September 16, 2015, from 6:00pm PST through approximately 8:00pm PST, at Buffalo Wild Wings Lloyd Center in accordance with the audition procedures described below. Any entries received after the Online Entry Period will be disqualified.
3. HOW TO ENTER: No Purchase Necessary. Void where prohibited or restricted by law.
a. Go to www.portlandscw32.com (the “Station Website”) during the Online Entry Period and follow the instructions to complete the entry form. In order to provide a qualified entry submission, you must provide all information requested on the Entry Form, including your name, age, address, contact information, a valid e-mail address and upload one (1) digital video demonstrating why you should be named the New Face of Portland’s CW (the “Entry Materials”). Video submission must consist of a single camera shot, one continuous take with no edits, sound effects, or other post-production effects. Video must be NO GREATER than 5 MB in size, NO LONGER than sixty-seconds in duration, and in one of the following formats:
Entrant must be the only person appearing in the video and the performance must be entrant’s own original work. The entry must not include any brand names, logos, company names, trademarks, service marks, copyrighted material including third parties’ music, or material that is in any way proprietary to another entity. Entrants must have a valid e-mail account in order to be eligible.
b. By entering, entrants represent and warrant that the essay and video/video performances are each the entrant’s own original work. Video submissions that are edited, altered or electronically enhanced will not be considered and will be disqualified. Entry materials that use this or copyrighted material of a third party may be disqualified. Sponsors reserve the right to disqualify those entries that contain offensive, obscene, profane, pornographic or inappropriate material, or entries deemed by the Sponsor to be unsuitable. The essay and video each must not contain defamatory or libelous statements (including but not limited to words that are considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group), it must not invade the privacy or any other rights of any person, firm, or entity, and it must not in any other way violate any applicable laws, regulations or broadcast standards. Entries that do not meet the foregoing requirements may be disqualified. Entrants agree to indemnify, defend and hold Sponsor harmless against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements (including attorneys’ fees and costs of litigation, settlement, judgment, interest and penalties) arising out of or related to a breach of the foregoing representations and warranties.
c. Incomplete or late entries will be disqualified and Sponsor is not responsible for online entries that are lost, late, garbled, deleted, or misdirected as a result of technical, internet, server, or other online difficulties. If any dispute arises as to identity of an entrant, such dispute will be resolved by Sponsor in its sole and absolute discretion, and Sponsor may disqualify any and all such disputed entries and entrants. Limit one entry per person. Multiple entries from the same person will be disqualified. Entry materials become the property of Sponsor and will not be returned or receipt acknowledged. Sponsor reserves the right to edit, broadcast, publish, display, and/or perform all or any part of entrants’ entry materials, in any media now known or hereinafter invented. Sponsor reserves the right in its sole discretion to reject any entry, to terminate any live audition performance, and/or to disqualify any participant based on inappropriate materials, behavior, or appearance.
d. If selected as a Finalist (per the criteria described below), entrants will be required to verify identity, age and residence, and to complete an Affidavit of Eligibility/Participant Release, and proof of a valid, unsuspended driver’s’ license.
a. This contest is open only to legal residents of Oregon or Washington, residing within the KRCW-TV viewing area, who are 21 years of age or older as of July 20, 2015. Entrants must possess a valid and unsuspended drivers’ license. Employees of Sponsor, Papa John’s, Buffalo Wild Wings, the Portland Aquarium and Next Adventure, their parent corporations, subsidiaries, or affiliates, advertising or promotional agencies and such employees’ immediate family or household members are not eligible to enter or win the contest. Anyone currently employed as on-camera anchor, reporter, program host or weathercaster for any television station, cable network or any other media is not eligible. Sponsor, in its sole discretion, will determine the eligibility of any and all contestants.
b. Entrants must be of good moral character, never been convicted of a crime of any nature (other than moving violations of a misdemeanor type that did not involve personal injury, drugs or alcohol), and must have nothing in their background that would be an embarrassment to the Station. Entrants may not be elected officials or a candidate for any elective office (local, state or federal), either at the time of entry or during the time period covered by the Prize. Entrants may be required to provide legally valid proof of age, identity, and residency.
5. WINNER SELECTION AND PRIZE:
a. On or about September 9, 2015, a panel consisting of KRCW-TV staff members will judge all qualified entry submissions on the sole criterion of who has the possibility of being “The New Face of Portland’s CW,” which will include, but not be limited to, subjective assessments of each entrant’s writing skills, appeal to KRCW-TV’s audience, and other unique factors. The twenty (20) entrants whose entries are selected by the judges to have the most potential according to the aforementioned criteria will be deemed Semi-Finalists subject to eligibility confirmation and compliance with these rules. Decisions of the KRCW-TV judges are incontestable, final and binding. KRCW-TV reserves the right to choose fewer than 20 Semi-Finalists, if there not enough entries that are deemed to meet the judging criteria.
Semi-Finalists will be notified by phone September 9, 2015 and must be available to participate in an On Site Audition Event to be held at the Buffalo Wild Wings Lloyd Center (1200 NE Broadway ste.20), on September 16, 2015, at 6pm.
b. On or about September 9, 2015, KRCW-TV will post the video submissions/auditions (the “Semi-Finalist Videos”) for each of the Semi-Finalists on the Station Website. Website visitors may “support” their favorite Semi-Finalist(s) from September 9, 2015 (beginning at 6:00am PST) through September 15, 2015 (11:59pm PST), by completely viewing Semi-Finalist Videos.
c. On September 16, 2015, an On Site Audition event will be held at the Buffalo Wild Wings Lloyd Center (1200 NE Broadway ste.20), for the Semi-Finalists. KRCW-TV will choose 4 Finalists who will be selected by a panel consisting of but not limited to Portland’s CW32 personnel, KRCW sponsors, and a radio DJ personality. Semi-finalists will perform before a live audience at the On-Site Audition in three competitions: (1) a talent competition, where the Semi-Finalist will demonstrate a personal talent, (2) memorizing a 30-second script and delivering it live on camera, and (3) performing an ad lib promotional announcement for KRCW-TV after being given “talking points.” Semi-Finalists will be judged on personality, appearance, style, overall performance, on-camera presence and communication skills and diction, self-confidence, credibility and charisma by the panel of judges. The Four Semi-Finalists whose are rated highest by the judges will be deemed Finalists. KRCW-TV reserves the right to select fewer than 4 Finalists, if it determines fewer than 4 of the Finalists meet the judging criteria. Finalists will be notified by phone September 17th, 2015.
Each Finalist must be available to participate in the production of 4 commercial announcements for event sponsors during the week of September 21, 2015. These commercials will air on KRCW October 5, 2015 through November 1, 2015. The commercials will also be posted on the KRCW website and viewers will be asked to vote for their favorites. (Voting does not affect selection of the Winner.) KRCW TV will direct the performances, edit and otherwise produce the commercials.
e. The Winner will be the Finalist whose entry is rated highest by the panel of judges, applying the criteria described in 5.c above, based on their competition at the On-Site Audition and in the four commercial announcements described in 5.d. The decision of the judging panel is incontestable, final and binding The Winner will be notified by phone during the week of November 2, 2015 and will be announced on Eye Opener on November 7, 2015.
f. The Winner will be declared “The New Face of Portland’s CW” and will receive the opportunity to perform on-camera and off-camera services and make appearances on KRCW-TV as determined by Station in its sole discretion, for a period of up to 24 weeks, starting November 9, 2015. The nature of services to be performed by the Winner and the dates and times for the performance thereof shall be determined exclusively by the Sponsor, and may include on-camera performances and appearances in Station promotional announcements and in Eye Opener segments, conducting on- and/or off-camera interviews in the market place, meetings with station clients and preparing and posting social media content as directed by the Station (such as posting on Station Facebook pages, Twitter and other social media). The Winner agrees to perform these activities as requested. Sponsor is not required to use the Winner’s services in connection with any particular program, promotion or activity, and may discontinue using the Winner in this role at any time, in its sole discretion.
The Winner will receive a prize of $2,500 cash in two installments of $1,250, paid at the beginning and the end of the 24-week period, respectively, subject to the Winner’s eligibility and full compliance with these Rules. (Approximate retail value of the prize: $2,500.) The Winner will receive no other compensation or benefits, including but not limited to any talent agency fee. In performing services, the winner agrees to comply with and conform to Sponsor’s broadcast standards with regard to conduct, dress and language during his or her appearances. Failure to comply with aforementioned standards may result in immediate disqualification.
e. All federal, state, and local taxes associated with the prize, as well as all other costs or expenses associated with the prize, including all travel and incidental expenses, are solely the responsibility of the Winner and each Finalist. Finalists other than the Winner will receive no monetary or other compensation.
f. The Winner will be required to sign a Participant Release & Agreement, and associated Affidavit related to compliance with FCC rules governing “plugola” and “payola.” The prize may be forfeited and awarded to another Finalist if Winner does not execute the prepared form of Release, or if selected Winner is not eligible or subject to disqualification in accordance with these rules.
g. No substitute prizes are available; however, Sponsor may, at its discretion, substitute prizes of equal or greater value. Prize is non-transferable, non-negotiable and not redeemable for cash, credit or merchandise. If the prize becomes unavailable for any reason, Sponsor reserves the right to substitute a prize of comparable value.
6. GENERAL CONDITIONS:
a. By entering, entrants grant to KRCW-TV an unlimited, non-exclusive, royalty-free right and license to broadcast, transmit, publish, display or exhibit entry submissions (including videos, photos/screen grabs, entry form responses and essays) in any medium now known or hereafter invented, in perpetuity. KRCW-TV reserves the right (but is not obligated) to post entry submissions online at www.portlandscw32.com or broadcast the entry materials on KRCW-TV.
b. If for any reason, the Internet-related portion of this contest is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the contest, KRCW-TV reserves the right, in its sole discretion, to terminate, modify, or suspend the contest or any portion of the contest. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS CONTEST WILL RESULT IN DISQUALIFICATION FROM THE CONTEST. Information submitted in entries, including entrant’s name, address, e-mail address, etc., may be used by KRCW-TV for marketing or promotional purposes.
c. Sponsor is not responsible and shall not be liable for any injuries, losses or damages of any kind caused by Entrant’s participation in the Contest or the Prize. The Prize is awarded “as is” with no warranty or guaranty, express or implied, by Sponsor. All entrants agree to release, indemnify and hold harmless Sponsor, its parent companies and affiliates, and each of their respective employees, representatives, sponsors and advertisers, from any and all liability, loss, damage, costs, causes of action or claims related to any allegation regarding participation in the Contest and any travel therein, the award, the receipt, or the use of any prize, including without limitation, personal injury, death, property damage, defamation, infringement of intellectual property rights, and claims based on the rights of publicity or privacy Sponsor is not responsible for any typographical or other error in the printing or advertising of the offer, administration or execution of the contest or in the announcements of the prizes/prize winners. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Official Rules or the failure, delay or omission by Sponsor in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of each Sponsor’s right to assert or rely upon any such provision or right in that or any other instance.
d. Sponsor reserves the right to delay contest announcements, postpone or reschedule all or some of the contest events, and/or modify contest deadlines at its sole discretion. Any such changes will be announced and posted on KRCW-TV’s website at www.portlandscw32.com.
e. This competition is not a hiring or employment decision, and Entrants, Finalists and Winner understand that KRCW-TV is not offering full-time, part-time or temporary employment in connection with this contest.
f. By participating in this contest, entrants (i) agree to have their names, photographs, voices, biographical information, likenesses, entry submissions (including the videos, essays and any other personal information provided in connection with the Contest) used in any and all media for promotional purposes relating to this contest or future similar contests without further compensation or notice; and (ii) represent that they agree to be bound by these rules and the decisions of the judges and Sponsor.
